A standard residential conveyancing transaction in NSW typically takes 4–6 weeks from exchange of contracts to settlement. The timeframe depends on the agreed settlement date in the contract, finance approval and the responsiveness of all parties. We keep you updated throughout the process.
Exchange is when both parties sign and swap identical copies of the contract, creating a binding agreement. Settlement is when the balance of the purchase price is paid and ownership transfers. There is usually a period of 4–6 weeks between exchange and settlement.
Both solicitors and licensed conveyancers can handle residential conveyancing in NSW. A solicitor can also advise on related legal issues — such as contract disputes, easements, caveats or estate matters — that fall outside the scope of a conveyancer. At Lake Macquarie City Legal, you receive solicitor-level advice for your transaction.
In NSW, residential property contracts have a 5 business day cooling-off period after exchange, during which the buyer can withdraw (forfeiting 0.25% of the purchase price). The cooling-off period does not apply to properties purchased at auction or where a 66W certificate is provided.
We conduct a range of searches including title search, land tax certificate, council rates certificate, water/sewerage certificate, and a planning certificate (s10.7). We also review any easements, covenants or restrictions on the title that may affect your use of the property.
PEXA (Property Exchange Australia) is the electronic settlement platform used for most property transactions in NSW. It allows settlement to occur digitally, reducing delays and errors. Yes, we are registered PEXA practitioners and conduct all eligible settlements electronically.
