It depends on the range of the offence and your history. Low range PCA carries a minimum 3-month automatic disqualification; mid range 6 months; high range 12 months. A court may impose a longer period. We work to achieve the minimum disqualification and explore non-conviction options such as a section 10 where appropriate.
NSW does not have a formal "work licence" scheme like Queensland. However, in some circumstances the court may impose a shorter disqualification period or a good behaviour licence. We will advise you on what options are realistically available for your specific matter.
A section 10 (now called a conditional release order without conviction) means the court finds the offence proven but does not record a conviction. This means no disqualification and no criminal record for the offence. It is not available in all cases and depends on your record, the circumstances and the court's discretion.
Drug driving (presence of a prescribed illicit drug) is a separate offence to driving under the influence. First offences typically attract a fine and licence disqualification. We can advise on the likely penalty for your specific circumstances and work to minimise the impact on your licence.
While you can represent yourself, having an experienced solicitor can make a significant difference — particularly for mid to high range drink driving, drug driving, or matters where you risk losing your licence. We offer fixed-fee arrangements for most traffic matters and a free first consultation.
