A BFA — sometimes called a prenup or postnup — is a legally enforceable contract under the Family Law Act 1975 that allows couples to agree in advance how their assets, superannuation and liabilities will be divided if the relationship breaks down. Both parties must receive independent legal advice and sign a certificate confirming this before the agreement is valid.
Property settlement in Australia is governed by the Family Law Act 1975 (not NSW state law). The court considers the contributions of each party (financial and non-financial), future needs, and what is just and equitable. There is no automatic 50/50 split. Parties can reach agreement by consent orders or a BFA without going to court.
Most family law matters are resolved without a court hearing through negotiation, mediation or consent orders. Court proceedings are a last resort when parties cannot reach agreement. We always explore cost-effective alternatives first.
If you were married, you have 12 months from the date your divorce is finalised to apply for a property settlement. If you were in a de facto relationship, you have 2 years from the date of separation. Acting promptly is important — contact us as soon as possible after separation.
Recent 2025 amendments to the Family Law Act require courts to give greater weight to the economic impact of family violence and financial abuse when determining property settlements. This means a history of coercive control or financial abuse can now more directly affect how assets are divided. A well-drafted BFA can provide certainty and avoid court entirely.
