Debt Recovery — Lake Macquarie & Newcastle
Recovering outstanding debts for individuals and businesses across NSW — from letters of demand and Local Court proceedings through to garnishee orders, examination notices and writs for levy of property.
Unpaid debts can have a serious impact on individuals and businesses alike. Whether you are owed money by a customer, a contractor, a tenant or a former business partner, Lake Macquarie City Legal provides practical, cost-effective debt recovery services across NSW.
We begin with pre-litigation strategies — a formal letter of demand or alternative dispute resolution — which resolve many debts without the cost and delay of court proceedings. Where a debtor remains uncooperative, we escalate by filing a Statement of Claim in the appropriate jurisdiction: the Local Court's Small Claims Division (up to $20,000), the Local Court's General Division (up to $100,000), or the District Court for larger amounts.
Once judgment is obtained, we pursue enforcement through every available legal mechanism — garnishee orders against bank accounts or wages, examination notices to identify assets, and writs for levy of property to seize and sell assets. We do not stop at judgment; we work until the debt is recovered.
All debt recovery work is conducted in strict compliance with the Australian Consumer Law, the ACCC/ASIC Debt Collection Guidelines, and NSW state legislation.
A complete pathway from first contact to full recovery — every step handled by an experienced NSW solicitor.
A formal, legally drafted letter of demand is often the most cost-effective first step — putting the debtor on notice and creating a paper trail for any future proceedings.
If the debtor does not respond, we file a Statement of Claim in the appropriate court — Local Court (up to $100,000) or District Court for larger debts.
Once judgment is obtained, we can apply for a garnishee order against the debtor's bank accounts or wages — directing funds directly to you.
We serve examination notices requiring the debtor to attend court and disclose their financial position — identifying assets available for enforcement.
A writ authorises the Sheriff to seize and sell the debtor's assets to satisfy the judgment debt — a powerful enforcement tool for significant debts.
We negotiate payment plans and lump-sum settlements on your behalf — often recovering funds faster and at lower cost than contested court proceedings.
The appropriate court depends on the amount owed. We advise on the right jurisdiction to maximise cost-effectiveness and recovery prospects.
Small Claims Division — Local Court NSW
Simplified procedure, limited legal costs recoverable. Suitable for straightforward consumer and small business debts.
General Division — Local Court NSW
Standard civil procedure. Legal costs are recoverable by the successful party. Most commercial debt recovery matters.
District Court NSW
For larger commercial debts. Full legal costs recoverable. More complex procedure and longer timeframes.
Supreme Court NSW
Highest state court. Reserved for the most significant debt recovery matters. Full legal costs recoverable.
We review the debt, assess recoverability and advise on the most cost-effective strategy — including whether pre-litigation steps are likely to succeed.
We draft and send a formal letter of demand giving the debtor a reasonable time to pay. Many debts are recovered at this stage without court involvement.
If the debtor does not pay, we file a Statement of Claim in the appropriate court. We handle all procedural steps through to judgment.
Once judgment is obtained, we pursue enforcement — garnishee orders, examination notices, writs for levy of property — until the debt is recovered.
The first step is usually a formal letter of demand — a legally drafted letter requiring the debtor to pay the outstanding amount within a specified time (typically 7–14 days). This is cost-effective, creates a formal record, and often resolves the matter without court proceedings. If the debtor does not respond, we escalate to filing a Statement of Claim in the appropriate court.
The appropriate court depends on the amount owed. The Local Court's Small Claims Division handles debts up to $20,000 with a simplified procedure. The Local Court's General Division handles debts up to $100,000. The District Court handles debts up to $750,000, and the Supreme Court handles debts above that threshold.
A garnishee order is a court order that directs a third party — such as the debtor's bank or employer — to pay money owed to the debtor directly to you instead. A bank garnishee order freezes and redirects funds from the debtor's account. A wage garnishee order redirects a portion of the debtor's wages. Garnishee orders are one of the most effective enforcement tools available after judgment.
An examination notice (or examination order) requires the judgment debtor to attend court and answer questions about their financial position under oath. This allows you to identify assets, bank accounts, employment and other financial resources that can be targeted for enforcement.
A writ for levy of property authorises the NSW Sheriff to attend the debtor's premises, seize their assets, and sell them to satisfy the judgment debt. It is one of the most powerful enforcement tools available and is typically used when other enforcement methods have been unsuccessful.
A letter of demand can be sent within days and may resolve the matter within 2–4 weeks. If court proceedings are necessary, an undefended matter in the Local Court can result in default judgment within 4–8 weeks. Defended matters take longer. Enforcement steps after judgment can begin immediately.
In the General Division of the Local Court and in higher courts, the successful party can usually recover a contribution toward their legal costs from the losing party. In the Small Claims Division, legal costs are generally not recoverable. We will advise you on the likely cost recovery position for your specific matter.
